AFRICA ECO VENTURES CC  TERMS AND CONDITIONS

The following is the terms of the agreement between Africa Eco Ventures CC and each of our customers.  Please review these terms carefully. If you have any questions about them please contact us.

You enter into this agreement with AFRICA ECO VENTURES CC when we receive the specified booking payment or deposit from you.

LIABILITIES

You accept that walking and hiking is an activity and that it can cause injury.

AFRICA ECO VENTURES CC  walks and hikes take place in an outdoor environment and are, by their very nature, not free from risk. AFRICA ECO VENTURES CC  take every precaution and make a huge effort  to ensure the safety and well-being of our customers. Activities take place in an outdoor environment the customer(s) must be aware and understand and agree that there are inherent dangers and certain unpredictability accompanying the activities. The customer(s) accepts responsibility for such risks to personal safety. The customer(s) accepts that to that extent he or she is taking part in a AFRICA ECO VENTURES CC  activity  at his or her own risk.

AFRICA ECO VENTURES CC  will not be liable for any injury that results from failure to follow its safety instructions.  The customer(s) acknowledges that other loss, damage and expense including, without limitation, loss of money, loss or damage to clothes, equipment and possessions, losses arising on the cancellation of a booking and the expenses of delay and harm is not the responsibility of AFRICA ECO VENTURES CC  and that AFRICA ECO VENTURES CC  liability is hereby limited.

Customers are required to sign an ACCIDENT WAIVER AND RELEASE OF LIABILITY FORM upon arrival, prior to the tour commencing.

All clients must obey the safety instructions of the guide at all times and agree not to act in any way that compromises the safety, enjoyment, learning or well-being of themselves, other participants, or staff.  AFRICA ECO VENTURES CC reserves the right to withdraw services, without refund, from any participant that does not follow safety instructions of the guide or in the guide’s judgement pose a safety risk.

AFRICA ECO VENTURES CC may ask a participant to withdraw from activities, without refund, if they are found, or seem, to suffer from a physical or mental condition that, in the guide’s judgement, poses a threat to safety.

AFRICA ECO VENTURES CC may ask a participant to withdraw from activities, without refund, if they are found, or seem, to be in very poor physical condition, or of very low personal fitness that, in the guide’s judgement, may compromise group well-being or safety

AFRICA ECO VENTURES CC will not tolerate verbal or physical abuse of other guests, our staff, our equipment, the accommodation, local people or the environment. Any breach of this will result in the immediate withdrawal of our services without refund, removal from the premises and may lead to prosecution.

PAYMENT

AFRICA ECO VENTURES CC require a deposit of 50% of the total amount to reserve your trip booking.

Final payment is due no later than 2 months before your hike begins. If this is not paid AFRICA ECO VENTURES CC reserve the right to regard the booking as cancelled and the participant will lose his or her deposit.

CANCELLATION

• Cancellation of a booking by a customer is only effective when received by AFRICA ECO VENTURES CC in writing by email. Address to send cancellations to: explore@ecoventures.co.za
• If written cancellation is not received one months prior to departure date, you will be held liable for the full cost, except if there is another customer  who can take your place.
• Deposit amount will be forfeited upon cancellation during the ttwo months before departure date

TRAVEL INSURANCE

It is recommended that the customer(s) may take out personal insurance to cover cancellation losses and if travel costs are likely to be high it is advisable to check availability of your preferred holiday dates before booking travel tickets.  AFRICA ECO VENTURES CC have to cancel for any reason, the customer(s) will be offered an alternative date. If this is not acceptable, the booked customer(s) will be eligible for a full refund (deductions for money transfers and exchange rate fluctuations may apply).

AFRICA ECO VENTURES CC  reserve the right to cancel activities without refund when we deem it dangerous to continue or due to combinations of adverse/dangerous environmental conditions. Definitions, including but not limited to: heavy consistent precipitation, floods, earthquakes, landslides, electrical storms (present or imminent) high winds, low visibility, resultant temperatures below 0ºC or above 40ºC, wild fires. Assessments will be made on a daily basis, and on-going throughout the activity.

AFRICA ECO VENTURES CC  reserve the right to cancel activities without refund due to clients not having proof of adequate personal insurance.

Except where stated differently, AFRICA ECO VENTURES CC will not be held liable for any compensation, damages, expenses, costs, losses or any other amount of any description or otherwise if we or your airline have to change or cancel your flight or holiday, or your flight cannot be provided as or when agreed as a result of circumstances or an event beyond our control.

In the unlikely event that the customer(s) has/have cause for complaint about AFRICA ECO VENTURES CC , the complaint should be made in the first instance to the guide so that corrective action can, if possible, be taken. The customer(s) acknowledges that it is unreasonable to take no action during a ride/walk/week/holiday with AFRICA ECO VENTURES CC but to complain later. However, should a problem not be resolved the complaint should be made in writing.
